To do that, market participants would need to believe that earnings estimates were off significantly.

The S & P 500 is closing out the first quarter on an epic win streak: The index is up 10% year to date and an amazing 25% in the past five months. About 70% of the S & P 500 is in the green this year. The S & P 500 advance/decline has been on a tear since the middle of January, with far more stocks advancing on a daily basis than declining. "We saw persistent strength with the S & P 500 up every month from November through February, and this has nearly always been followed by more months of strength," he said.

The U.S. Securities and Exchange Commission on Wednesday voted to adopt new rules that will require most publicly traded companies to disclose climate-related risks in their registration statements and annual reports. The rule proposal was first made in March 2022, but the SEC extended the public comment period several times. He noted the SEC has continuously updated its disclosure requirements over the years, including those related to environmental risks. SEC staff members have noted that nearly 40% of publicly traded companies already disclose information about climate-related risk in their annual reports, but there is no common reporting framework. Despite the odds, active managers turned in a better-than-expected performance in 2023, according to a report out today by S & P Global. The bad news: the long-term performance of active managers remained dismal. The majority (60%) of large-cap fund managers underperformed the S & P 500 in 2023, according to S & P Global. While that may not seem like an impressive performance, it is slightly better than the historic average of 64% that underperform the S & P 500. Surprising, because 2023 was a tough year for active managers.

The Scope 3 disclosure requirements have drawn strong criticism from many corporations, who claim the regulations are too burdensome. The climate disclosure rule was first proposed in March 2022. Since Congress has not passed major climate legislation for years, opponents of the SEC's climate rule will likely sue the SEC and cite West Virginia v. EPA, again arguing that Congress has not granted specific authority for the SEC to act on climate change.
